Action commenced by plaintiff Herman F. Schwarz against defendant Nannette R. Winter for damages arising out of personal injuries sustained in a collision between the automobiles of the parties on May 16, 1952. The case was tried to the court without a jury, and upon finding that plaintiff was negligent as to lookout and defendant was negligent as to speed and control and management, the court apportioned the negligence 40% to plaintiff and 60% to defendant. From a judgment in favor of plaintiff for $6,000 and costs, defendant appeals. Plaintiff has filed a motion for review.
